HB 3874 addresses contract fairness in construction agreements by making certain provisions voidable if relevant documents are not provided in advance. It allows contractors and subcontractors to void clauses that incorporate external documents by reference if those documents are not provided at least 10 days before contract execution. The bill requires owners and general contractors to provide electronic or paper copies of referenced documents upon request and prohibits the waiver of these rights by contract. It also makes exceptions for publicly available documents and emergency situations​.
