HB 3965 grants counties and municipalities the authority to prohibit the sale of cigarettes, e-cigarettes, or tobacco products near certain locations. Local governments may pass ordinances restricting such sales within 300 feet of a church, public hospital, or primary or secondary school. Upon request from a school district or private school, the restriction may extend to 1,000 feet from the school campus. However, the restriction does not apply to businesses where less than 50% of their gross sales come from tobacco products​.
