HB 4038 grants political subdivisions the authority to regulate the installation of communication facility structures near the habitats of endangered species. It amends the Local Government Code to require that such structures be placed at least twice their height away from designated endangered species habitats. The bill also modifies the approval process for constructing communication towers in unincorporated county areas.
