HB 408 prohibits the Texas Department of Transportation (TxDOT) from giving preference to bids for road construction materials based solely on environmental, social, and governance (ESG) criteria, including carbon emissions, when those materials are less cost-effective or less durable than alternatives. This restriction applies to all bids for materials used in road construction projects managed by TxDOT. The bill is set to take effect on September 1, 2025.
