Digest
HB 412 amends Subchapter E of Chapter 1367 in the Insurance Code to enhance health benefit plan coverage for early childhood intervention (ECI) services. The bill broadens coverage for rehabilitative and habilitative therapies to include specialized skills training, applied behavior analysis, and case management, while requiring health benefit plans to provide, rather than merely offer, coverage for these services. It prohibits annual or lifetime benefit caps on therapies related to ECI and sets a maximum annual limit of $9,000 for specialized skills training, excluding other therapies or Medicaid benefits. Additionally, insurance coverage must be exhausted before accessing state-funded ECI services under the Individuals with Disabilities Education Act (IDEA). The bill also strengthens protections against adverse actions, such as premium increases or coverage terminations, based solely on the cost of therapies. The new requirements apply to health plans delivered, issued, or renewed on or after January 1, 2026, with the act effective September 1, 2025.
