HB 432 establishes requirements for conducting national instant criminal background checks for private firearm transfers. It prohibits individuals from selling or transferring a firearm unless they are a licensed firearms dealer or the transaction involves a family member within the first degree of consanguinity or affinity, or a background check is conducted through a licensed firearms dealer. Licensed dealers facilitating these checks must comply with federal regulations under 18 U.S.C. Section 922 and may charge a reasonable fee for the service. Violations of these provisions constitute a Class A misdemeanor. The legislation is set to take effect on September 1, 2025.
