Digest
HB 448 amends Chapter 822 of the Health and Safety Code to permit municipal animal control authorities to operate within a municipality’s extraterritorial jurisdiction (ETJ) under certain conditions. The bill authorizes these authorities to seize and impound a dangerous or aggressive dog based on a notarized affidavit signed by at least two residents from different households in the ETJ. The affidavit must assert that the dog has repeatedly attacked humans, domestic animals, or livestock, creating an unsafe environment. This authority applies only if no animal control entity is authorized to operate in the ETJ or if the existing entity lacks the capability to handle dangerous or aggressive dogs. The act takes effect immediately with a two-thirds vote in each legislative chamber or on September 1, 2025, otherwise.
