HB 459 amends Subchapter F, Chapter 86 of the Natural Resources Code by adding Section 86.186, directing the Railroad Commission of Texas to establish a policy for eliminating routine flaring of natural gas from wells and facilities it regulates by December 31, 2031. The policy may include regulatory, incentive-based, or voluntary measures, as well as interim goals for individual wells, facilities, or operators. It allows flaring only for safety or emergency purposes or as otherwise authorized under Section 86.185 of the Natural Resources Code. Extended flaring for purposes unrelated to safety or emergencies is explicitly prohibited. The act will take effect on September 1, 2025.
