Digest
HB 468 revises sections of the Education Code, Health and Safety Code, and Human Resources Code concerning immunization requirements for children. The bill removes the authority of the executive commissioner of the Health and Human Services Commission to add or modify immunizations required for admission to public or private primary and secondary schools. Instead, the Department of State Health Services must annually publish a list of required immunizations for public schools, ensuring the information is accessible in both English and Spanish. The bill prohibits governmental entities from mandating immunizations except for those explicitly required by statute and repeals provisions in the Education Code that previously allowed modifications to immunization requirements. Future adjustments to immunization policies can only be authorized by the legislature. The bill also clarifies immunization requirements for child-care facilities and establishes a streamlined process for provisional admission for children who have started but not completed required vaccinations. These changes will apply starting with the 2025–2026 school year, with the act becoming effective on September 1, 2025, unless enacted earlier through an emergency clause.
