HB 5642 mandates that real estate license holders provide written disclosures about transfer on death deeds when discussing residential property purchases with clients. The Texas Real Estate Commission will develop a standardized disclosure form, which must explain the benefits, legal effects, and impact on wills associated with such deeds. The requirement applies to all residential real estate transactions beginning January 1, 2026.
