HB 716 revises penalties for noncompliance with fire marshal orders under Section 352.022 of the Local Government Code. The offense is reduced to a Class C misdemeanor unless bodily injury or death results, in which case it becomes a Class A misdemeanor. Repeat offenses escalate penalties, with a state jail felony imposed after two prior convictions. Additionally, the bill authorizes certified fire inspectors in counties with large populations to issue citations for fire safety violations, but not to make arrests. The Act is effective September 1, 2025.
