HB 858 shortens the waiting period for filing a petition for nondisclosure of criminal history records for individuals placed on deferred adjudication community supervision. For misdemeanors, the wait is reduced to one year for most offenses and two years for specific misdemeanors. For felonies, the waiting period is reduced to three years. The law applies to offenses discharged or dismissed on or after September 1, 2025.
