Digest
HB 867 amends the Code of Criminal Procedure to require that any criminal case dismissed by the state’s attorney include a detailed written statement of the specific reasons for dismissal, such as lack of evidence or actual innocence. If dismissal is due to law enforcement misconduct, the state’s attorney must document the issue, refer it for internal review, and consider criminal charges against the officer. Judicial consent remains required for dismissal. The Act takes effect September 1, 2025.
