HB 981 amends the Texas Government Code to refine provisions under the public information law related to litigation, law enforcement, corrections, and prosecutorial records. It modifies Section 552.103 to stipulate that litigation must be "reasonably anticipated" only if a written threat of legal action or a written demand for compensation has been made against a governmental body. The bill also amends Section 552.108 to allow subjects of specific law enforcement or prosecutorial records—or their legal representatives, surviving family members, or estate administrators—to access certain internal records or notations that would otherwise be exempt from public disclosure. These changes apply prospectively to requests for information received on or after September 1, 2025.
