SB 1234 amends Section 22.041 of the Texas Penal Code to broaden the presumption of endangerment in cases involving a child, elderly individual, or disabled individual when certain controlled substances are involved. Specifically, it adds controlled substances listed in Penalty Group 1-B of the Texas Controlled Substances Act, in addition to methamphetamine, as substances that, if manufactured, possessed, or introduced in the presence of or within proximity to these vulnerable individuals, constitute a presumption of imminent danger of death or bodily harm. This change extends existing protections to cover the possession or exposure to other harmful drugs, addressing potential dangers to individuals at higher risk of harm.
