SB 1251 grants certificated telecommunications providers the right to nondiscriminatory access to the rights-of-way and distribution poles of electric cooperatives. It establishes Chapter 254 of the Utilities Code, which prohibits electric cooperatives from charging pole attachment rates that exceed those set in contracts or those that would be permitted under federal law if the Federal Communications Commission regulated the cooperative’s rates. The Public Utility Commission of Texas (PUC) is given authority to review and enforce compliance with these provisions through contested case proceedings.
