SB 1440 requires prosecuting attorneys to report discretionary decisions to the Texas Attorney General when refusing to prosecute certain offenses, including violent and property crimes. The report must include a justification for the decision, any evidentiary concerns, and the alleged offender’s criminal history. The Attorney General must publish monthly summaries of these decisions, omitting personally identifying information​.
