SB 1573 limits the use of unsubstantiated allegations of misconduct against peace officers in criminal proceedings. It prohibits law enforcement agencies from disclosing allegations to prosecutors unless they have been adjudicated as sustained. Additionally, prosecutors cannot consider allegations that remain under appeal when assessing an officer’s credibility as a witness. If a peace officer disputes a misconduct determination, they may petition a district court, which must decide by a preponderance of the evidence whether the alleged misconduct occurred. If the court finds insufficient evidence, the allegation cannot be used against the officer in legal proceedings.
