SB 1602 establishes a new criminal offense for trespassing on or near school and day-care center properties. The bill adds Section 30.055 to the Texas Penal Code, defining trespass on these properties to include entry onto school or day-care center property, or within 250 feet of such property, if the individual poses a substantial risk of harm or behaves inappropriately for the setting. The offense requires that the individual, after being asked to leave by authorized personnel, fails to depart. An offense under this section is classified as a Class A misdemeanor.
