SB 2451 creates a grant program to assist local law enforcement agencies in testing substances suspected of containing delta-9 tetrahydrocannabinol (THC) at concentrations exceeding 0.3% by dry weight. The grants would be administered by the Criminal Justice Division of the Texas Governor’s Office and could only be used to fund third-party laboratory testing. Law enforcement agencies receiving funds must report on the number and type of substances tested, the number of positive THC results, the costs of testing, and the legal outcomes related to the tested substances. The bill also mandates that the Criminal Justice Division include a report on the program’s performance in its biennial report.
