Digest
SB 561 establishes the Office of Environmental Justice within the Texas Commission on Environmental Quality. The office's purpose is to protect the public health, welfare, and property of environmental justice communities, which are identified based on poverty levels or racial and ethnic minority populations. It requires the office to evaluate and provide recommendations on permits for facilities near these communities by considering factors such as cumulative pollution effects, health vulnerabilities, and proximity to sensitive locations like schools and hospitals. The recommendations must be submitted promptly after the public comment period ends, and the Texas Commission on Environmental Quality must consider these recommendations in permit decisions. The office is authorized to use outside technical support and must be adequately staffed to perform its duties. The provisions apply to permit applications submitted after the bill's effective date, September 1, 2025.
