Digest
SB 948 amends the Property Code to establish the confidentiality of records related to residential eviction cases under specific circumstances. Courts are required to make eviction case information confidential if the judgment is in favor of the tenant, the case is dismissed without relief granted to the plaintiff, or if the eviction case is brought by a successor in interest following foreclosure against a non-defaulting tenant. Additionally, tenants may petition for confidentiality after five years or under similar conditions. Confidentiality also applies to records during the pendency of an appeal. Once information is deemed confidential, courts, clerks, and certain entities are restricted from disclosing it, with limited exceptions. Violations of these provisions result in liability for actual or exemplary damages, capped at $1,000, along with reasonable attorney’s fees up to $10,000. The bill aims to prevent the use of eviction case information in tenant screening or credit reporting in such cases.
