Digest
SJR 45 proposes a constitutional amendment allowing the legislature to enact laws denying bail to individuals accused of committing trafficking or sexual offenses against a child while released on bail for a similar offense. It specifies the qualifying offenses, including aggravated kidnapping with sexual intent, sexual assault, and compelling prostitution, among others. The amendment would require a judge or magistrate to determine, by a preponderance of the evidence, that the accused committed the subsequent offense while on bail. The proposed amendment will be presented to voters for approval in the election on November 4, 2025.
