Digest
HB 424 amends Section 54.052 of the Education Code, altering the criteria for determining residency status for tuition purposes at public institutions of higher education. The bill removes the provision granting residency status to individuals who graduate from a Texas high school or earn an equivalent diploma and have resided in the state for three years prior to graduation. Instead, residency status will be based solely on establishing a domicile in Texas for at least one year prior to the census date or being the dependent of a parent who meets this requirement. Additionally, the bill explicitly prohibits individuals not authorized under federal law to be in the United States from being classified as Texas residents for tuition purposes. Institutions may reclassify students previously deemed residents if they no longer meet the amended requirements. These changes will take effect on September 1, 2025.
